1. PURPOSE & SCOPE

1.1. These Sales Terms and Conditions (“Terms”) govern all purchases made through the website www.theperfumeatelier.com (the “Website”).

1.2. The Website offers perfumes and fragrance-related products intended for international customers.

1.3. By placing an order on the Website, the customer confirms acceptance of these Terms without reservation.

1.4. The Seller reserves the right to amend these Terms at any time. The version applicable is the one in force at the date the order is placed.

2. PRODUCTS

2.1. The Website offers niche perfumes and related fragrance products (the “Products”).

2.2. Each Product is presented with a description outlining its essential characteristics. Product images are illustrative and may differ slightly from the delivered Product.

2.3. Due to the artisanal and olfactory nature of perfumes, variations in packaging, color or presentation may occur and do not affect product conformity.

3. AVAILABILITY

3.1. Products are offered subject to availability.

3.2. In the event that a Product becomes unavailable after an order is placed, the customer will be informed as soon as reasonably possible and offered either:

• a refund, or

• an alternative Product, subject to customer approval.

4. ORDER PROCESS

4.1. Orders are placed by selecting Products and completing the checkout process on the Website.

4.2. Customers may review and correct their order before final confirmation.

4.3. An order becomes binding only upon receipt of an order confirmation email.

4.4. The Seller reserves the right to refuse or cancel any order in cases of suspected fraud, violation of these Terms, abnormal quantities, or payment issues.

5. PRICES & CURRENCY

5.1. All prices are displayed in euros (EUR).

5.2. Prices include applicable taxes unless otherwise stated.

5.3. Delivery costs, customs duties, import taxes, or local charges applicable in the destination country are not included unless explicitly stated and remain the responsibility of the customer.

5.4. The total payable amount is clearly displayed before order confirmation.

6. PAYMENT

6.1. Payment is due in full at the time of order placement.

6.2. Accepted payment methods are displayed during checkout.

6.3. All transactions are processed through secure payment systems.

6.4. Ownership of the Products remains with the Seller until full payment is received.

7. DELIVERY

7.1. Products are delivered to the address provided by the customer during checkout.

7.2. Estimated delivery times are provided for information purposes only and may vary depending on destination and carrier.

7.3. The Seller shall not be liable for delays caused by carriers, customs authorities, force majeure events, or incorrect delivery information provided by the customer.

7.4. Risk of loss or damage passes to the customer upon delivery.

8. RECEIPT OF PRODUCTS

8.1. Customers must inspect the Products upon delivery.

8.2. Any visible damage, missing items or delivery errors must be reported within three (3) days of receipt.

9. RIGHT OF WITHDRAWAL (CONSUMERS ONLY)

9.1. In accordance with applicable Serbian consumer protection law, consumers have the right to withdraw from the purchase within 14 calendar days from the date of receipt of the Products, without providing a reason.

9.2. To exercise the right of withdrawal, the customer must notify the Seller in a clear written statement (email is sufficient).

9.3. Products must be returned within 14 days from the withdrawal notice.

9.4. Returned Products must be unused, unopened, in their original packaging and in resaleable condition.

9.5. Return shipping costs are borne by the customer unless otherwise agreed.

10. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to:

• sealed perfumes or cosmetic products that have been unsealed after delivery for hygiene or health reasons,

• personalised or custom-made Products,

• Products damaged due to improper handling after delivery.

11. REFUNDS

11.1. Refunds are issued using the original payment method.

11.2. Refunds are processed within 14 days from receipt and inspection of the returned Products.

11.3. Delivery costs are refunded only if the entire order is returned.

12. NON-CONFORMING, DEFECTIVE OR DAMAGED PRODUCTS

12.1. Products are considered non-conforming if they are damaged, leaking, incorrectly supplied, or defective at the time of delivery.

12.2. Due to the nature of perfumes, repair is not possible. In the event of a validated defect, the customer may request:

• replacement of the Product, subject to availability; or

• a refund of the purchase price.

12.3. Claims must be submitted within a reasonable time after discovery and include the order number, a description of the issue, and photographic evidence where applicable.

12.4. If the claim is accepted, reasonable return shipping costs will be covered by the Seller.

12.5. This section does not cover dissatisfaction based on scent preference, normal product characteristics, or damage occurring after delivery.

13. LIABILITY

13.1. The Seller is liable only for direct and foreseeable damages resulting from a breach of these Terms.

13.2. The Seller shall not be liable for indirect, incidental or consequential damages, to the extent permitted by applicable law.

13.3. Nothing in these Terms limits mandatory consumer rights.

14. INTELLECTUAL PROPERTY

14.1. All content on the Website, including text, images, trademarks, logos and designs, is protected by intellectual property laws.

14.2. Any reproduction, use or distribution without prior written consent is prohibited.

15. PERSONAL DATA

Personal data is processed in accordance with applicable data protection laws and the Website’s Privacy Policy.

16. GOVERNING LAW & JURISDICTION

16.1. These Terms are governed by the laws of the Republic of Serbia.

16.2. Any disputes shall fall under the jurisdiction of the competent courts in Serbia, unless mandatory consumer protection rules provide otherwise.
