Welcome to the online shop of The Perfume Atelier d.o.o. (hereinafter referred to as the “Seller”, “we”, “us”, or “our”). These Terms of Sale and Delivery (the “Terms”) govern all purchases, shipping arrangements, and fulfillment options made through the website theperfumeatelier.com (the “Website”).
1. Purpose & Scope
  • 1.1. Application: These Terms govern all purchases made through the Website.
  • 1.2. Intended Audience: The Website offers perfumes and fragrance-related products intended for international and domestic customers.
  • 1.3. Explicit Acceptance: By placing an order on the Website, the customer confirms acceptance of these Terms without reservation.
  • 1.4. Right to Amend: The Seller reserves the right to amend these Terms at any time. The version applicable to an order is the one in force at the exact date the order is placed.
2. Products & Specifications
  • 2.1. Product Range: The Website offers niche perfumes and related fragrance products (the “Products”).
  • 2.2. Visual Representation: Each Product is presented with a description outlining its essential characteristics. Product images are illustrative and may differ slightly from the delivered item.
  • 2.3. Artisanal Nature: Due to the artisanal and olfactory nature of perfumes, variations in packaging, colour, or presentation may occur and do not affect product conformity.
3. Product Availability
  • 3.1. Inventory Limits: Products are offered subject to operational availability.
  • 3.2. Unavailability Solutions: In the event that a Product becomes unavailable after an order is placed, the customer will be informed as soon as reasonably possible and offered either:
    • A full refund of the amount paid, or
    • An alternative Product, subject to explicit customer approval.
4. Order Process
  • 4.1. Placing an Order: Orders are placed by selecting Products and completing the checkout process on the Website.
  • 4.2. Verification: Customers may review and correct their order details before final confirmation.
  • 4.3. Binding Contract: An order becomes legally binding only upon receipt of a formal order confirmation email from us.
  • 4.4. Order Refusal: The Seller reserves the right to refuse or cancel any order in cases of suspected fraud, violation of these Terms, abnormal ordering quantities, or outstanding payment issues.
5. Prices, Currency, and Customs
  • 5.1. Base Currency: All prices are displayed and processed in Euros (EUR).
  • 5.2. Taxation: Prices include applicable taxes unless otherwise stated.
  • 5.3. Duties and Import Fees: For international deliveries, customers are solely responsible for all customs duties, import taxes, and fees imposed by the destination country. These charges are not included in our purchase price or shipping costs and must be paid by the recipient upon delivery.
  • 5.4. Transparency: The total payable amount is clearly displayed to the customer before order confirmation.
6. Payment Terms
  • 6.1. Timing: Payment is due in full at the time of order placement.
  • 6.2. Methods: Accepted payment methods are displayed clearly during the checkout stage.
  • 6.3. Transaction Security: All transactions are processed through secure, encrypted external payment gateway systems.
  • 6.4. Retention of Title: Ownership of the Products remains entirely with the Seller until full payment is successfully received.
7. Delivery & Shipping Methods
  • 7.1. Delivery Address: Orders will be shipped to the delivery address provided by the customer at the time of purchase. Please ensure that your shipping details are fully accurate.
  • 7.2. Flat Shipping Fee: The Perfume Atelier d.o.o. offers international shipping with a flat delivery fee of 12 EUR worldwide. This fee is fixed for all products in your order and will not change based on the size, weight, or value of your purchase.
  • 7.3. Notifications: Once your order is processed and ready to be shipped, you will receive an email confirmation with shipping details and the expected delivery date. All shipments are sent via reliable courier services.
  • 7.4. Delivery Times: Estimated delivery times are provided for information purposes only and may vary depending on the destination, local carrier efficiency, or customs clearance.
  • 7.5. Delays & Liability: The Seller is not responsible for customs delays, additional administrative charges, or delays caused by carriers, force majeure events, or incorrect delivery information provided by the customer.
  • 7.6. Transfer of Risk: Risk of loss or damage passes to the customer upon successful delivery to the specified address.
8. Free In-Store Pickup Option
  • 8.1. Local Pickup: Customers have the option of free pickup from our physical location: The Perfume Atelier, Beogradska 33, Belgrade, Serbia.
  • 8.2. How to Select: To use this option, select “Personal Pickup” during checkout to avoid delivery fees.
  • 8.3. Collection Notice: Once your order is ready for pickup, you will be notified via email or phone. This option is ideal for local customers who wish to personally see and test products before final collection.
9. Inspection and Receipt of Products
  • 9.1. Customer Inspection: Customers must inspect the condition of the Products immediately upon delivery.
  • 9.2. Damage Claims Window: Any visible damage, leaking, missing items, or delivery errors must be reported to us in writing within three (3) days of receipt.
10. Consumer Right of Withdrawal (Returns)
  • 10.1. 14-Day Window: In accordance with applicable Serbian consumer protection law, consumers have the right to withdraw from the purchase within 14 calendar days from the date of receipt of the Products, without providing a reason.
  • 10.2. Formal Notification: To exercise the right of withdrawal, the customer must notify the Seller in a clear written statement (email sent to [email protected] is sufficient).
  • 10.3. Return Timeline: Products must be returned to us within 14 days from the date the withdrawal notice was sent.
  • 10.4. Return Condition: Returned Products must be unused, unopened, in their original packaging, with all seals intact, and in perfect resaleable condition.
  • 10.5. Return Shipping Costs: Return shipping costs are borne entirely by the customer unless otherwise agreed in writing.
11. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:
  • Sealed perfumes or cosmetic products that have been unsealed after delivery for hygiene or health reasons.
  • Personalised, engraved, or custom-made Products.
  • Products damaged due to improper handling or storage after delivery.
12. Refunds
  • 12.1. Original Payment Method: Refunds are issued strictly using the original payment method utilized during the purchase.
  • 12.2. Processing Time: Refunds are processed within 14 days from receipt and inspection of the returned Products at our atelier.
  • 12.3. Delivery Fee Refund: Original delivery costs are refunded only if the entire order is returned.
13. Non-Conforming, Defective, or Damaged Products
  • 13.1. Definition: Products are considered non-conforming if they arrive damaged, leaking, incorrectly supplied, or defective at the time of delivery.
  • 13.2. Resolution Options: Due to the fine nature of perfumes, repair is not possible. In the event of a validated defect, the customer may request:
    • A replacement of the Product, subject to availability; or
    • A full refund of the purchase price.
  • 13.3. Evidence Submission: Claims must be submitted within a reasonable time after discovery. Submissions must include the order number, a clear description of the issue, and photographic evidence.
  • 13.4. Return Coverage: If the claim is accepted, reasonable return shipping costs will be covered by the Seller.
  • 13.5. Exclusions: This section does not cover personal dissatisfaction based on scent preference, normal natural product characteristics, or damage occurring after safe delivery.
14. Liability and Website Material
  • 14.1. Liability Limits: The Seller is liable only for direct and foreseeable damages resulting from a proven breach of these Terms. We shall not be liable for indirect, incidental, or consequential damages.
  • 14.2. Intellectual Property: All content on the Website—including texts, images, formulation names, trademarks, logos, and designs—is protected by intellectual property laws. Any reproduction or distribution without prior written consent is strictly prohibited.
15. Governing Law & Jurisdiction
  • 15.1. Applicable Law: These Terms are governed by and construed in accordance with the laws of the Republic of Serbia.
  • 15.2. Competent Courts: Any disputes arising from these Terms shall fall under the exclusive jurisdiction of the competent courts in Belgrade, Serbia.
